Rosebud Sioux Tribal Court Information
Criminal Court
The criminal division of the Rosebud Sioux Tribal Court is housed at the Adult Corrections facility located on Highway 18 between Rosebud Junction and Soldier Creek. The Public Defender staff and the Pretrial Officer are also located at the Adult Corrections facility.
Except for holidays, the criminal division has the following schedule:
- Arraignments for incarcerated defendants are held at 2:00 p.m. on Mondays, Wednesdays and Fridays;
- Return arraignments are set for Thursdays at 9:00 a.m. and 2:00 p.m.;
- Pre-trials are scheduled for Wednesdays at 9:00 a.m.;
- Bench trials are scheduled on Tuesdays at 9:00 a.m.;
- and Jury trials are scheduled on Mondays at 9:00 a.m. (at Rosebud Courthouse).
When the Rosebud Sioux Tribe calls an administrative leave day, arraignments, pretrials, returns, bench trials and jury trials must be rescheduled for another day. Bonds for incarcerated individuals may be paid/posted at the Adult Corrections facility. The Rosebud Sioux Tribe’s Prosecutor staff are located in the Annex behind the Tribal Administration building in Rosebud, SD.
Probation
The criminal court’s Probation Officers and the Community Service Monitor are housed in the Rosebud Courthouse located at 118 Marshall Street in Rosebud, South Dakota. These Probation Officers and the Community Service Monitor are on-site every week day except for holidays or when they are in Court or out in the field. Probation reviews are scheduled on Thursdays every week.
Should the Rosebud Sioux Tribe have administrative leave, the review hearing scheduled for that day will be held the following Thursday.
Community Service applications can be submitted any day of the week when there is no holiday or administrative leave.
Civil Court
The civil division of the Rosebud Sioux Tribal Court is housed in the Courthouse located at 118 Marshall Street in Rosebud, South Dakota. Court administration, adult probation, community service, the Adult Wellness Court, and the Supreme Court are also located at the Courthouse.
Except for holidays, civil hearings are scheduled Tuesday through Friday every week, however, when the Rosebud Sioux Tribe calls an administrative leave day, hearings must be rescheduled (continued) to another day.
Criminal jury trials and civil trials are held at the Rosebud Courthouse. Jurors summoned for jury trials should report there.
Fines are to be paid at the Courthouse. Bond refunds, child support and restitution payments are issued by the Chief Clerk of Courts and can be picked up at the Courthouse.
Children’s Court
The juvenile (Children’s Court) division of the Rosebud Sioux Tribal Court is housed at the Wanbli Wiconi Tipi (Juvenile Detention Center) located on Highway 18 between Rosebud Junction and Soldier Creek. The Youth Wellness Court, Truancy, Juvenile Public Defender and Juvenile Court Probation Officers are also housed at the Juvenile Detention Center.
Except for holidays, the Children’s Court has the following schedule:
- Juvenile Offender cases are scheduled on Mondays and Wednesdays (minors who are arrested are scheduled as needed, within 48 hours);
- Children In Need of Supervision cases are scheduled on Mondays and Wednesdays;
- Minor In Need Of Care (abuse and neglect) cases are scheduled on Tuesdays and Thursdays (Emergency Custody hearings are scheduled as needed, within 48 hours);
- Truancy hearings are scheduled on Fridays;
- Wellness team meetings are scheduled on Mondays;
When the Rosebud Sioux Tribe calls an administrative leave day, Children’s Court hearings/meetings must be rescheduled for another day.
Wellness Court: In the mid 1990s, the Rosebud Sioux Tribal Children’s Court established a “Wellness Court '' under the Tribal Juvenile Drug Court Program. This Wellness Court is an alternative to incarceration in the Rosebud Sioux Tribal Children’s Court. It is a 12-18-month court monitored rehabilitative program for the youth ages 12-17, aimed at intervening in alcohol and or drug use and nonviolent juvenile delinquency. Youth who have alcohol/drug related offenses and no violent felony crimes or any youth with drug and or alcohol issues that would benefit from intense supervision from the court may participate. Youths can be referred from Court's first offenders program, Child in Need of Supervision cases and Truancy cases. The Wellness Court is advised by a Wellness Team that include educators, social workers, truancy personnel, drug and alcohol service providers, local mental health professionals.
