16-2-113. CIVIL ACTION FOR DAMAGES.

Any person who has been adversely affected by any act or practice which is unlawful under Section 101 of this chapter shall be permitted to bring a civil action in Tribal Court for rescission and for the recovery of actual damages together with the costs of suit and a reasonable attorney’s fees. The court may in its discretion increase the award of damages in an amount not to exceed three times the amount of actual damages; provided, however, that the amount by which the award is increased shall not exceed One Thousand Dollars ($1,000.00).
