19-7-101. FINDINGS AND PURPOSES.
The Tribal Council finds that:
- The health and welfare of the Rosebud Sioux tribal members and other persons who reside on the Rosebud Reservation and the opportunities for economic development on the Reservation are at risk from the indiscriminate and uncontrolled disposal of solid waste on the Reservation;
- Solid Waste is generated by Indians and non-Indians on the Rosebud Reservation and Indians and non-Indians alike suffer from improper disposal;
- The improper disposal of solid waste on the Reservation is contrary to the historic close relationship between the people of the Rosebud Sioux Tribe and their land;
- The continued growth of population and economic activity on the Reservation will generate greater amounts of solid waste;
- Federal law requires extensive management of solid waste;
- There is a need for an organized effort to manage properly the disposal of solid waste on the Rosebud Reservation; and
- The Rosebud Sioux Tribe, as the properly constituted sovereign government of the Rosebud Reservation should undertake to regulate and manage the disposal of solid waste.
The purposes of this Chapter are to:
- Provide environmental and health standards for the collection and disposal of solid waste;
- Prohibit future open dumping and littering of waste on the Reservation and eliminate unhealthy, unsightly and indiscriminate disposal or placement of solid waste; and
- Inform and educate persons living on the Reservation of the need to participate fully in efforts to manage solid waste generation, transportation, and disposal on the Reservation.
