19-7-123. OPERATING CRITERIA-TEMPORARY SOLID WASTE STORAGE.

  1. Definitions.
    1. Temporary Solid Waste Storage Facility - A solid waste storage facility at which solid waste is temporary placed in or on the land for later removal to a final disposal site.
    2. Liquid Waste - Waste that is unable to pass a paint filter test.
    3. Disease Vector - Any rodent, flies, mosquitoes or other animal capable of transmitting disease to humans.
  2. Procedures for excluding hazardous waste.
    1. Program for detection and preventing disposal shall include:
      1. random inspection of loads unless other steps are taken to avoid hazardous wastes.
      2. record-keeping.
      3. training.
      4. procedures to notify the Rosebud Sioux Water Resources of the occurrence of hazardous waste.
  3. Daily Cover.
    1. Shall use six (6) inches of earthen material cover at the end of each day or more frequently if necessary.
    2. May use alternative material and thickness.
    3. May approve temporary waivers in extreme climatic conditions.
  4. Disease Vector.
    1. Shall utilize measures to control on site disease vector populations.
  5. Air Criteria.
    1. Open burning shall be banned.
    2. Infrequent burning shall be allowed for:
      1. agricultural.
      2. silvicultural.
      3. land clearing debris.
      4. diseased trees.
      5. emergency clean-up operations.
    3. Shall require compliance with Rosebud Sioux Tribal plans.
  6. Access Control shall:
    1. Protect human health and the environment.
    2. Prevent unauthorized traffic.
    3. Prevent illegal dumping.
    4. Shall allow use of artificial or natural barriers.
  7. Surface Drainage Control.
    1. Control run-on onto temporary storage site.
    2. Control run-off existing temporary storage site.
  8. Liquid Restrictions.
    1. Bulk or non-containerized liquid shall be prohibited unless:
      1. household liquids other than septic waste.
    2. Shall prohibit containers unless:
      1. household size.
      2. designated to hold liquids for uses other than storage.
      3. is household waste.
  9. Record-keeping shall include:
    1. Inspection of records by the enforcing agency. Rosebud Sioux Tribe Water Resources.
    2. Training procedures and documentation.
    3. Records of the weight or volume of solid waste delivered to the temporary solid waste storage/landfill facility.
