8-10-7. TRIBAL COURT EXCLUSION HEARING.

After notice to the respondent and complaining witness, as provided for in Section 8, the Tribal Court shall hold a hearing for the purpose of determining the facts and recommending to the Tribal Court what action, if any, should be taken. The respondent shall be given an opportunity to present his defense at the hearing, including evidence, witnesses and argument, and may be represented by counsel at his own expense. The Tribal Court may, in its discretion, grant a continuance of the hearing on request by the Tribal Prosecutor or respondent, or upon its own motion.
