905. LICENSE REQUIRED OF DISTRIBUTORS AND WHOLESALERS.

Each person, except a retailer, engaging in the business of selling cigarettes within the Reservation, including any distributor or wholesaler, shall secure license from the Tax Commission, pursuant to regulations issued by it, or as otherwise provided by this Chapter. Each license issued under this section shall be prominently displayed on the premises covered by such license. Any person who shall violate the provisions of this section shall be subject to a civil penalty of not less than $25.00 or more than $200, and all cigarettes in his possession shall be seized and forfeited to the Tribe. Compliance with this section in no way waives the requirements of Chapter 12 regarding tribal business licenses.
