5-11-7. POSSESSION OF FIREARM OR DANGEROUS WEAPON WHILE INTOXICATED.

Any person who, being under the influence of an alcoholic beverage or controlled substance or drug or medication or any other substance whatever, who has in his possession or under his custody or control any firearm or other dangerous weapon is guilty of possession of a firearm while intoxicated.

Possession of a firearm while intoxicated is a Class C crime if the firearm was unloaded.

Possession of a firearm while intoxicated is a Class B crime if the firearm was loaded.

Possession of any other dangerous weapon while intoxicated is a Class B crime.
