5-18-4. Public Intoxication and Possession of Intoxicating Substances While in Public

  1. PUBLIC INTOXICATION - A person shall not use or consume an alcoholic beverage, liquor, wine or beer, upon the public streets or highways, and shall not consume or use an alcoholic beverage, liquor, wine or beer, except in any public premises covered by a liquor license.

Public intoxication is a Class B offense.

  1. A person shall not possess an alcoholic beverage, liquor, wine, beer, in a public place or upon the public streets or highways, with the seal of the original package broken, except in any public place covered by a liquor license.

Possession of an alcoholic beverage while in public is a Class B offense.
