5-2-6 SERVING JAIL TIME IN LIEU OF PAYMENT OF FINE.

In the event that a fine is imposed by the Court and the Defendant is unable or unwilling to pay the fine, the Court may order the same to be served out in jail at the rate set out by tribal resolution, as it deems without need to amend by ordinance. 

In addition, if the defendant is willing to work during the period of incarceration either while serving out a fine or serving out a jail sentence, the Court may in its discretion grant additional credit against the jail term or fine for the work performed by the defendant during the period of incarceration.
