5-21-1. DEFRAUDING CREDITORS.
- Destroys, removes, conceals, encumbers, transfers, or otherwise deals with property subject to a valid security interest, lien, or mortgage, with the intent to hinder enforcement of said security interest, lien, or mortgage; or
- Knowing that proceedings have been or are about to be instituted for the appointment of a receiver or other person entitled to administer property for the benefit of creditors:
- Destroys, removes, encumbers, transfers, or otherwise deals with any property with the intent to defeat or obstruct the operation of any law relating to administration of property for the benefit of creditors; or
- Knowingly falsifies any writing or record relating to said property; or
- Knowingly misrepresents or refuses to disclose to any person entitled to administer property for the benefit of creditors, the existence, amount, or location of said property, or any other information which the actor could legally be required to furnish in relation to such administration;
is guilty of defrauding creditors.
Defrauding creditors is a Class A crime.
