5-30-4. SELLING OFFICIAL CONDUCT.
Any public officer or employee who asks for or receives any pecuniary benefit for the performance of any official function which has not been performed, or who asks for or receives any pecuniary benefit for doing any official act, is guilty of selling official conduct.
It is an affirmative defense to a charge under this section that the fees or consideration received or requested by the public official were authorized by law or required to be collected by law.
Selling official conduct is a Class A crime.
