5-7-13 Sexual Exploitation of a Minor

A person is guilty of sexual exploitation of a minor if the person causes or knowingly permits a minor to engage in an activity or the simulation of any activity, through any means of communication (including but not limited to the internet, photographs, phone, instant messaging, texting, etc.) that:

1. Involves nudity;
2. Is obscene; or
3. Is intended to be sexually arousing to the actor.

Consent to performing these acts by a minor or a minor's parent, guardian, or custodian, or mistake as to the minor's age is not a defense to a charge of violating this section.

Sexual Exploitation of a Minor is a Class A offense.
