5-7-14 Definitions
For the purposes of this chapter, the following definitions apply:
- “Sexual Penetration” means-
- contact involving penetration, however slight, between the penis and the vulva or the penis and the anus;
- contact between the mouth and the penis, the mouth and the vulva, or the mouth and the anus; or
- the penetration, however slight, of the anal or genital opening of another by a hand or finger or by any object, with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person;
- “Sexual Act” means-
- sexual penetration; or
- the intentional touching, not through the clothing, of the genitalia of another person who has not attained the age of sixteen (16) years with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person;
- “Sexual Contact” means the intentional touching, either directly or through the clothing, of the genitalia, anus, groin, breast, inner thigh, or buttocks of any person with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person;
- “Psychotherapist” means any physician, psychologist, nurse, chemical dependency counselor, social worker, member of the clergy, a medicine man or spiritual leader, as those terms are defined by the traditional laws of the Rosebud Sioux Tribe, marriage and family therapist, mental health service provider, or other person, whether or not licensed or certified, who performs or purports to perform psychotherapy;
- “Psychotherapist’s patient” means any person who seeks or obtains psychotherapeutic services from the psychotherapist.
