RULE 3. COMMENCEMENT OF ACTION.
- A civil action is commenced by filing a written Complaint and Summons with the Clerk of the Tribal Court and by delivery of copies of the Summons and Complaint by the Plaintiff or his attorney to the appropriate officials for purpose of service on the Defendants.
- The Summons shall be legibly signed by the Plaintiff of his attorney and directed to the Defendant and shall require the Defendants to answer the Complaint and serve a copy of his Answer on the person signing the Summons at a place within the State specified in the Summons at which there is no post office within thirty (30) days after service of the Summons and Complaint exclusive of the day of service. The Summons shall further notify the Defendant that in case of his failure to file and Answer, judgment by default may be rendered against him for the relief requested in the Complaint.
