9-1-11. REMOVAL OF JUDGES.
Any Judge may be removed from office prior to the expiration of his or her term by a majority vote of the Tribal Council and upon recommendation of the Judiciary Committee. The grounds for such removal shall be neglect of duty, gross misconduct, incompetence, or other just cause, and only after the holding of a public hearing before the Tribal Council, by giving such Judge no less than five (5) days notice of such hearing. At the hearing the Judge shall be given the opportunity to answer all charges and present evidence in his own behalf. After such hearing removal of a Judge may only be accompanied by a two-thirds (2/3) vote of the Tribal Council members present at the hearing and constitute a quorum. The Judiciary Committee shall have the power to suspend a Judge, after investigation and hearing, for a period not to exceed thirty (30) days pending a hearing before the Tribal Council for dismissal of such Judge.
