6-2-1. DEFINITION OF RECKLESS DRIVING.
Any person who drives any vehicle upon a highway carelessly and needlessly in disregard of the rights of safety of others, or without due caution and circumspection and at a speed, or in a manner so as to endanger or be likely to endanger any person or property, is guilty of reckless driving. Reckless is a Class B offense.
- If a conviction is a second or a subsequent Reckless Driving Offense within a two (2) year period, such person shall be guilty of a Class A offense and the Court shall make an Order prohibiting such person from driving on the Rosebud Reservation for a period of thirty (30) days. The Court may, in its discretion extend such period, not to exceed one (1) year.
