3-3-5. PETITION.

The Petition may be prepared and filed by the Presenting Office, Probation Officer, Police Officer, parent, guardian, or a representative of the Tribal Social Services, BIA Social Services, South Dakota Department of Social Services or other Tribally recognized agency or concerned individual with knowledge of the facts.  All petitions shall be screened by the Presenting Office or Prosecutor.  At any time after a petition is filed, the Court may make an Order for Temporary Custody of the child.
