3-4-5. INTERVENTION IN CHILD CUSTODY PROCEEDINGS IN STATE COURT - AMENDMENT
- Procedure: the procedure for intervening in State Indian Child Welfare proceedings shall be as follows:
- The Rosebud Sioux Tribe’s ICWA Specialist may take necessary action to have the Tribe intervene as a party in a state court child custody proceeding, if in the informed opinion of the specialist, intervention is appropriate under the facts and the law. A decision to intervene does not need to be approved by the Children’s Court Judge.
- It shall be the policy of the Rosebud Sioux Tribe to intervene as a party in all state court child custody proceedings involving an Indian child who is an enrolled member or who is eligible for membership in the Tribe, except in extraordinary circumstances.
