2-1-17. PROPERTY DIVISION.
In a decree of divorce or separate maintenance, the Court shall have full power to make an equitable division of the property belonging to either party or both parties whether the title to such property is in the name of the husband or the wife. In making such division of the property, the Court shall have due regard for the equity and circumstances of the parties and the contributions by each at the time of the marriage. The degree of fault by each of the parties should not be a significant factor in determining property division. However, maintenance of children may be considered by the Court in awarding property.
