2-1-21. VISITATION RIGHTS FOR GRANDPARENTS.

The Tribal Court may grant grandparents reasonable rights of visitation with their grandchildren with or without petition of the grandparents if it is in the best interests of the grandchildren.  The grandparents of the child may petition the Tribal Court for grandchild visitation rights if the parents of the child are divorced or legally separated, or an action for divorce or separate maintenance has been commenced by one of the parents of the child, or if the parent of the child who is the child of the grandparent is dead.  The Tribal Court may grant a petition for grandchild visitation rights only upon finding that such visitation is in the best interests of the child.  Petitions for visitation by grandparents may be denied by the Court in circumstances where the child has been placed for adoption with a person other than the child’s stepparent or grandparent.
