2-3-1. DEFINITION.
For the purpose of this chapter, the following terms shall have the following meanings, unless the context clearly indicated otherwise:
- “Abuse” means inflicting or attempting to inflict physical injury on an adult by other than accidental means, physical restraint, or malicious damage to the personal property of the abused party;
- “Adult” means any person eighteen (18) years of age or older or who is otherwise emancipated;
- “Court” means the Rosebud Sioux Tribal Court;
- “Family or household member” means spouse, persons living with spouses, persons related by blood or marriage, and other persons jointly residing in the same dwelling unit who are eighteen (18) years of age or older, or who are emancipated;
- “Petitioner” means person alleging abuse in a petition for order of protection;
- “Respondent” means person alleged to have abused another in a petition for order of protection.
